


U.S. Trade Representative Jamieson Greer stated that the Trump administration is ready to implement new tariffs “the next day” if the Supreme Court were to overturn the current global customs duties. In an interview with the New York Times, Greer noted that the administration has completed its preparations for a potential court ruling.
The tariffs in question were implemented based on the International Emergency Economic Powers Act (IEEPA) of 1977, following President Donald Trump's return to office in January 2025. This legal process is considered an important case that tests the scope of Trump's emergency powers as used by the Supreme Court. The court's decision is expected to be announced in the coming weeks, possibly as soon as Tuesday.
Treasury Secretary Scott Bessent pointed out alternative legal measures that could be enacted if a cancellation decision were issued under the IEEPA. In this context, the administration has the right to impose comprehensive customs duties of 15 percent for a period of 150 days based on a 1974 law, citing trade imbalances as justification.
Additionally, it is reported that the Trump administration is considering a 1930 law that would allow for customs duties of up to 50 percent on countries that engage in discriminatory practices against U.S. trade. These preparations indicate that the administration intends to maintain its customs duty policy regardless of the Supreme Court's decision.
