Ankara 42nd Civil Court of First Instance rejected the case filed for the annulment of the Cumhuriyet Halk Partisi's (CHP) 38th Ordinary and 21st Extraordinary Congress without justification. The court made this decision due to the lack of subject matter.
The case was filed by former Hatay Metropolitan Municipality Mayor Lütfü Savaş and was dismissed due to the absence of active dispute, while similar cases initiated by other plaintiffs were also ruled as lacking subject matter.
The lawsuits filed after allegations that the votes of the delegates at CHP's 38th Ordinary Congress were bought in exchange for bribes were initially launched in different courts and were later consolidated in the 42nd Civil Court of First Instance. During the hearing held on September 15, the court board found the plaintiffs' requests for injunction unfounded and postponed the case.
This decision came after the announcement that the significant congress, where the CHP's General Chairperson will be elected, will be held in Ankara on November 28-30. Following the decision, the Borsa Istanbul 100 index increased by more than 4%, while the daily rise in the banking index exceeded 7%. The daily loss of the Turkish Lira against the dollar decreased to 0.1%.
At the beginning of the hearing, the judge announced that the requested information and documents dated September 15 had been entered into the case file. The plaintiff's lawyers expressed that they were awaiting a decision, stating, "The law cannot remain indifferent to such a unlawful act."
The defendant's lawyer requested the rejection of the demands, referring to the CHP's bylaws, stating, "The delegates' term ends with the next election."
