Important Regulation from the Ministry of Justice

The Ministry of Justice has published a new regulation aimed at increasing the accessibility of notary services. With this regulation, it will be ensured that notaries provide services to citizens on weekends by being on duty on Saturdays and Sundays. The regulation aims to determine the number of on-duty notaries based on the total number of notaries in the province, and that the duty lists will be approved by the Union of Turkish Notaries and published online.

Details of the On-Duty Notary Application

One of the fundamental elements of the new regulation is that notaries will be on duty on weekends, provided that it does not coincide with official holidays. With this application, notaries will ensure that transactions continue without interruption. Transactions carried out by on-duty notaries will be assigned a journal number that continues from the day before the transaction date. Additionally, only wills preparation and urgent transactions will be allowed on holiday days when the on-duty service is not provided.

Determining the Number of On-Duty Notaries

According to the rules set out in the regulation, at least one notary will be on duty in provincial centers that have a minimum of 4 and a maximum of 20 notaries. In provincial centers with more than 20 notaries, at least 5% of the total number of notaries will provide on-duty notary services. The determination of the on-duty notary count will be carried out in light of the opinions of the notary chamber and the Union of Turkish Notaries.

Publication of On-Duty Lists

On-duty lists will be prepared by notary chambers as primary and secondary and will be submitted to the Union of Turkish Notaries at least three weeks in advance. Once the approval process is complete, the lists will be published on the official website within a week. It will be mandatory for notaries to be on duty on the published days.

On-Duty Hours and Working Arrangement

The working hours set for on-duty notary services are planned to be from 09:00 to 17:00 every day of the week. The lunch break will be held between 12:30 and 13:30. Additionally, in cases specified by law, deputy notaries will also be included in the on-duty system. All notary transactions will be conducted in accordance with the applicable legislative provisions.
