According to the new regulation published in the Official Gazette, notaries will work on Saturday and Sunday except for public holiday days. In this context, the details of the notary duty system have been determined.
Notary duties will be carried out on Saturday and Sunday, provided that they do not coincide with public holiday days. Transactions conducted by on-duty notaries will be recorded with the journal number of the day before the transaction date.
In the absence of on-duty services during holiday days, notary transactions that may cause harm due to delays, such as wills preparation and certification, can be performed.
In provincial centers, if there are at least 4 notaries, 1 of them will provide on-duty notary services, and if there are more than 20 notaries, 5% of the total number of notaries will provide on-duty notary services. In districts outside the provincial center, the provision and number of on-duty notary services will be determined by the Ministry of Justice, considering the current workload.
Notary chambers will submit the lists of on-duty notaries they have determined for at least 3 months in advance to the approval of the Union of Turkish Notaries. Approved lists will be announced on the Union's website. The daily working hours of on-duty notaries will be between 09:00 and 17:00, with a lunch break from 12:30 to 13:30.
