Competition Violations and Penalties

Koruma Klor has been fined a total of 497 million TL as a result of two separate competition investigations conducted in the chlor-alkali sector. This situation stands out as an important development in terms of competition violation and the impact on market dynamics.

Collusive Bids

In the first investigation, it was determined that Koruma Klor acted in concert with some small and medium-sized companies by following a collusive method in tenders. As a result of these anti-competitive practices, a total administrative fine of 333.3 million TL was imposed on the enterprises.

Predatory Pricing Practices

In the second investigation, Koruma Klor abused its power in the market by implementing predatory pricing policies that distorted competition. The attempt to push its competitors out of the market by selling below cost resulted in a penalty of approximately 164.5 million TL.

Assessment of the Board

The Competition Authority announced both of its decisions to the public on its website. Emphasizing that the identified violations are serious, the Authority pointed out that such practices disrupt the balances in the sector.

Immediately after the results of the investigations conducted against various companies, heavy penalties were imposed on Koruma Klor and other affiliated companies for violating Articles 4 and 6 of the Law on the Protection of Competition.
