The Spanish Ministry of Consumer Affairs has decided to impose a fine of €64.05 million on Airbnb for advertising and selling unlicensed tourist accommodations. In a written statement, the ministry indicated that the fine has been finalized and all administrative appeal avenues have been exhausted.
The ministry also issued additional penalties stating that Airbnb must rectify the identified violations, remove illegal content, and publicly disclose the imposed fine.
The investigations revealed a total of 65,122 unlicensed listings. As a result of these violations, a fine was imposed equal to 'six times' the illegal profits obtained for the duration from the ministry's warning to the removal of these listings.
The consumer association FACUA filed a complaint regarding this situation, demanding an effective fight against real estate frauds. Additionally, they emphasized that the fine imposed on Airbnb is the second largest in its sector following the €108 million fine issued to Ryanair. They congratulated the Ministry of Consumer Affairs for this decisive stance.
In Spain, which broke a record with 85.7 million tourists in the first quarter of 2025, current data shows that there are approximately 400,000 licensed tourist rental homes. In this context, effective measures are being taken against illegal accommodation services.
