The U.S. Chamber of Commerce has filed a lawsuit challenging the establishment of a $100,000 application fee for the H-1B visa, which allows highly skilled workers to work in the U.S.
In the announcement, it was emphasized that the government's regulations are in violation of the rules under the Immigration and Nationality Act. The lawsuit was filed in the Washington District Court, stating that the new fee would seriously impact the H-1B program.
Neil Bradley, Executive Vice President and Chief Policy Officer of the U.S. Chamber of Commerce, noted that the new fee would make it financially impossible for especially start-ups and small and medium-sized enterprises to utilize the H-1B program.
Last month, Donald Trump signed an executive order regarding the H-1B visa, raising the application fee to $100,000. This decision, while criticized by many employers, brought the issue of access to a highly skilled workforce to the forefront.
